Terms and Conditions for monthly subscriptions:
Monthly Unlimited Membership allows the member unlimited class attendances per month to any classes offered by MFit.
Personal Training Subscriptions allows members to book sessions as outlined in the product description. Personalized workouts and coaching support will be provided through the Virtuagym app.
Subscription fees will be charged on the 1st of each month for the coming month.
No refunds after fees are collected on the first of each month.
Member must notify Metrick Fitness via email of cancellation of subscription BEFORE the first of the month to cancel the next month's membership. For memberships started after the 1st of the month, fees will be prorated for the remainder of that month, with full month's charge occurring the next month.
There are no contracts or cancellation fees. However, if the member chooses to reinstate their subscription within 6 months of cancellation, there will be a $150 reinstatement fee. This fee will be waived if member chooses to move to a different membership option, such as class package, or switching from Group Fitness Membership to Personal Training (i.e., no lapse in membership)
Terms and Conditions for Class Packages
Class packages expire the respective number of days after purchase as stated in the product description. No refunds on packages after purchase or reimbursements of unused sessions after expiration date. Members of the same household may share class packages.
General Terms and Conditions
Member/guest agrees to show proof of Covid-19 Vaccination before entering the facility.
Member/guest agrees to follow all social distancing and sanitation guidelines. Failure to follow these guidelines may result in dismissal from class until such guidelines are followed.
LIABILITY WAIVER AND ACKNOWLEDGEMENT OF RISK (WAIVER)
REGISTRATION IS INCOMPLETE WITHOUT SIGNATURE AND MUST BE COMPLETED
In consideration of my use of the exercise equipment, facilities, and participation in group or private fitness classes (collectively, the Activities), at the facilities located at 5333 W 86th Street, Indianapolis, Indiana 46268 (the Premises) provided by Stephanie Metrick, LLC d/b/a Metrick Fitness and/or any related parties (collectively, the Company), I expressly agree and contract on behalf of myself, my heirs, executors, administrators, successors and assigns, that the Company and its insurers, employees, officers, directors, associates, related parties, affiliates and agents shall not be liable for any damages including those arising from personal injuries (including death) sustained by me, or my guests in, on, or about the Premises, or as a result of engagement in the Activities, regardless of whether such injuries result, in whole or in part, from the condition or defectiveness of the equipment, facilities or Premises or the negligence of the Company.
By the execution of this Waiver, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me or my guests, and I hereby fully and forever release and discharge the Company, its insurers, employees, officers, directors, associates, related parties, affiliates and agents from any and all lawsuits, claims, demands, damages, rights of action, causes of action or any other liability, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of the entry upon the Premises or the Activities.
I expressly agree to indemnify, defend and hold harmless the Company from and against any and all lawsuits, claims, demands, damages, rights of action, causes of action or any other liability, of any person or entity, that may arise from the injuries or damages sustained by me or my guests in any way relating to the Premises or the Activities.
I agree to be solely responsible for the safety and well-being of my guests and myself. My guests and I understand that the Company does not provide supervision for the use of the facilities and equipment and have a full understanding, based on my own review of the proper means and manner to use the facilities and equipment, as do my guests.
I agree to comply with all rules, whether posted or verbally stated by the Company, regarding the use of the Premises and engagement in the Activities. I agree to, at all times, conduct myself in a controlled and reasonable manner, and to refrain from using any equipment in a manner inconsistent with its intended design and purpose, and to ensure the same of my guests.
I understand and acknowledged that the use of exercise equipment involves risk of serious injury, including permanent disability and death, and have advised my guests of the same. I understand and agree that the Company is not responsible for property that is lost, stolen, or damaged while in, on, or about the Premises, and have advised my guests of the same.
I hereby grant the Company permission to use my likeness in a photograph, video, or other digital media (Photos) in any and all of its publications, including web-based publications, without payment or other consideration. I understand and agree that all Photos will become the property of the Company and I hereby authorize the Company to alter, copy, exhibit, publish or distribute these Photos for any lawful purposes.
